Attorneys Rob Sullivan obtains $7,000,000.00 verdict in Federal Court
November 10, 2011. A Harrison, Arkansas jury awarded $7 million verdict in a wrongful death lawsuit brought against Dunaway Timber Company and its truck driver Morgan Quisenberry in the Western District of Arkansas Federal Court. Sullivan Law attorney Rob Sullivan served as counsel for the family of Roger Reagan who was killed in a semi-truck accident in Yellville, Arkansas in September of 2008.
Reagan was killed when a truck driven by Quisenberry crossed the center line and struck two other vehicles before colliding with a semi-truck driven by Reagan. Although eyewitnesses testified that they saw Quisenberry cross the centerline first, the Arkansas State Police accident investigation concluded that another vehicle that came to rest over the centerline in the defendant’s lane was at fault for crossing the centerline and colliding with the Dunaway truck. Former lead accident reconstructionist for the State Police, Steve Jackson testified as an expert for the defense, bolstering the conclusions of the State Trooper who had investigated the accident.
Throughout the course of the trial Sullivan repeatedly cast doubt on the conclusions of the Trooper and Mr. Jackson culminating in back to back cross examinations that left no doubt in the jurors’ minds that the Dunaway Timber truck driver was at fault in the deadly crash. The jury also heard evidence that the Dunaway driver was likely fatigued and driving over the hours of service limits set by Federal Law.
After several hours of deliberation, the jury returned a unanimous verdict that awarded $7,000,000 to Mr. Reagan’s family.
